Basic provisions

These Terms and Conditions of Purchase and Sale (hereinafter referred to as the “Terms and Conditions”) set out the rights, obligations and responsibilities between the person purchasing goods in the 4sezonai.lt online shop (hereinafter referred to as the “Buyer”) and MB Gamtara (hereinafter referred to as the “Seller”), company code 306716828. By purchasing goods in the online shop, the Buyer agrees to the application of these Terms and Conditions.

1. Seller’s rights and obligations

1.1 The Seller has the right to unilaterally change these Terms and Conditions by posting the new Terms and Conditions on the e-shop website. The amendments shall take effect from the moment of publication for all transactions entered into after the publication.

1.2 The Seller undertakes to use its best endeavours to enable the Buyer to make proper use of the services provided by the Online Shop. The Seller makes no warranty that the operation of the online shop will be uninterrupted or that the transmission of data will be error-free. The Seller shall not be liable for any losses incurred by the Buyer in connection with malfunctions and/or data transmission errors in the electronic shop.

1.3 In the event of serious circumstances where the Seller is unable to provide the Buyer with the goods ordered, the Seller undertakes to offer an equivalent product or to refund the Buyer’s payment within 3 working days. In this case, the Seller shall be released from liability for non-delivery.

1.4 The Seller shall have other rights and obligations provided for in the Terms and Conditions and the legislation of the Republic of Lithuania.

2. Rights and obligations of the buyer

2.1 The Buyer shall have the right to purchase goods in the e-shop in accordance with these Terms and Conditions and the legislation of the Republic of Lithuania.

2.2 Upon receipt of the consignment, the Buyer must check that the consignment is undamaged (wet or otherwise externally damaged) and must also check that the consignment is not internally damaged and that all the goods ordered have arrived. If the parcel is damaged or missing certain goods, the parcel must not be accepted.

2.3 Upon acceptance by the Buyer or the Buyer’s representative, the consignment shall be deemed to have been delivered in undamaged packaging and shall be deemed to be in accordance with the quantity, quality and range of goods.

2.4 The Buyer shall pay the price of the Goods and their delivery, as well as any other payments (if specified at the time of the conclusion of the Contract), and accept the Goods ordered. The Buyer shall pay for the Goods by the methods specified in the e-shop: e-banking or by wire transfer from any other bank to the Seller’s account specified in the Seller’s particulars.

3. Payment of goods

3.1 The price of the goods in the online shop shall be quoted in Euros including VAT.

3.2 The Buyer shall make payment using the e-banking system. After the payment has been made by e-banking, the order shall be processed from the date on which the money paid by the Buyer is credited to the Seller’s bank account.

3.4 If the details provided in the Buyer’s registration form change, the Buyer must update them immediately, otherwise the Seller shall not be liable for any non-delivery or delay of the goods.

4. Delivery of goods

4.1 The goods shall be delivered in the territory of the Republic of Lithuania by a courier company indicated by the Seller.

4.2 The Goods shall be dispatched to the Buyer within 1-4 working days after confirmation of payment.

4.3 In all cases, the Seller shall be exempt from liability for failure to meet delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Seller’s control.

4.4 The Buyer undertakes to accept the Goods himself. Upon delivery of the Goods to the address specified in the Order Form, the Goods shall be deemed to have been duly delivered to the Buyer, irrespective of whether the Goods have actually been accepted by the Buyer or by any other person who has taken delivery of the Goods at the address specified. In such case, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the goods to the wrong person and/or any other claim relating to delivery.

4.5 The Buyer, upon acceptance of the Goods, shall, together with the person delivering the Goods, inspect the condition, quantity, quality and completeness of the Goods delivered. If the Buyer notices/identifies any discrepancy in the quantity, quality, composition, etc. of the Goods, the Buyer shall not accept the Goods and shall note such discrepancy in the handover-acceptance documents. If the Buyer accepts the goods, in some cases, and signs the handover acceptance documents without any comments, it shall be deemed that the handed over goods are in proper condition, without defects, the quantity, quality, and assembly of the goods comply with the terms of the sale and purchase agreement and the Buyer shall not have any claims against the Seller.

5. Return of goods

5.1 In the event that the goods are of poor quality, the Buyer must inform the 4sezonai.lt e-shop administration within 24 hours by e-mail: info@4sezonai.lt or by phone: +370 616 07336.

5.2 In the event of a complaint about poor product quality, a photograph and description of the poor product must be provided.

5.3 Goods shall be returned in the original packaging of the goods and the parcel, together with the product documents. Before returning the goods, the Buyer must contact the Seller at the email address info@4sezonai.lt

5.4 The Buyer is responsible for the proper packaging of the returned goods. If the goods are not properly packed, the Seller shall not accept the returned goods.

5.5 The Seller shall download the defective product at its own expense and replace it with a product of satisfactory quality or refund the money paid for the defective product to the Buyer.

5.6 In the event that the Buyer wishes to receive a refund for returned goods of unsatisfactory quality, the Buyer must submit a request for a refund to info@4sezonai.lt. In the refund request, the Buyer must specify: name, order number, name of the defective goods, quantity and reason for the refund. The Buyer shall be refunded the money back to the bank account from which the goods were paid for. The refund shall be made within 3 working days of the Buyer’s written (email) request and dispatch of the faulty goods to the Seller.

5.7 In all cases of return, the buyer must first contact the contacts provided and only after receiving information from the store representative, proceed with the return via courier.

6. Shared responsibility

6.1 The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer shall be liable for the consequences of any inaccuracy or inaccuracy of the data provided in the registration form.

6.2 The parties shall be liable for the breach of the contract of purchase and sale concluded through the electronic shop in accordance with the procedure established by the legislation of the Republic of Lithuania.

6.3 The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods displayed in the online shop do not correspond to the actual size, shape and colour of the goods due to the characteristics of the display used by the Buyer.

7. Exchange of information

7.1 The Seller shall send all notices and otherwise contact the Buyer at the email address or telephone number provided by the Buyer in the registration form.

8. Final provisions

8.1 These Terms and Conditions are made in accordance with the laws of the Republic of Lithuania.

8.2 The law of the Republic of Lithuania shall apply to relations arising under these Terms and Conditions.

8.3 In the event of damage, the party at fault shall indemnify the other party for direct damages in accordance with the procedure and on the grounds established by the laws of the Republic of Lithuania.

8.4 All disputes arising out of the operation of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.

8.5 All textual and graphic information published in the 4sezonai.lt e-shop is protected by the laws of the Republic of Lithuania and is the intellectual property of the Seller.

These Purchase Rules were approved on 18 April 2022 and may be amended at any time.
